DE|RIVE® AMBASSADOR PROGRAM TERMS & CONDITIONS

These Ambassador Program Terms & Conditions (“Terms”) govern participation in the DE|RIVE® Ambassador Program (“Program”). By applying to, enrolling in, or participating in the Program, you (“Ambassador,” “you,” or “your”) agree to these Terms.
1. PROGRAM ELIGIBILITY & ACCEPTANCE
Participation in the DE|RIVE® Ambassador Program is subject to application and approval by DE|RIVE®. Submission of an application does not guarantee acceptance.
To participate, you must:
- Be at least 18 years of age;
- Provide accurate and complete information during the application process;
- Maintain an active email address and any social media accounts used in connection with the Program;
- Comply with these Terms and all applicable laws, regulations, and platform policies; and
- Reside in a location in which participation in the Program and receipt of commissions are legally permitted.
DE|RIVE® reserves the right to approve or decline any application at its discretion.
2. HOW THE PROGRAM WORKS
Approved Ambassadors may receive a unique referral link and/or promotional discount code to share with their audience.
When an eligible customer completes a qualifying purchase using your designated referral link or discount code, you may earn a commission in accordance with the commission structure communicated to you through the Program.
Referral links and codes are assigned to the individual Ambassador and may not be transferred, sold, or assigned to another person or entity.
3. COMMISSIONS & QUALIFYING PURCHASES
Commission rates, qualifying products, promotional offers, payment schedules, minimum payout thresholds, and other compensation details will be communicated through your Ambassador account, dashboard, or other Program materials.
Commissions are earned only on qualifying purchases that can be properly attributed to your Ambassador account.
Commissions may not be paid on:
- Canceled orders;
- Returned or refunded purchases;
- Fraudulent or unauthorized transactions;
- Orders placed in violation of these Terms;
- Self-referrals or other transactions intended primarily to generate commission, unless expressly permitted by DE|RIVE®;
- Purchases for which another promotional or referral source receives attribution; or
- Any other transaction determined by DE|RIVE® to be ineligible.
DE|RIVE® reserves the right to reverse, withhold, or adjust commissions associated with returns, refunds, chargebacks, fraudulent activity, Program abuse, or errors.
Commission rates and Program incentives may be modified from time to time.
4. AMBASSADOR DISCOUNTS & PROMOTIONS
Ambassadors may be provided with promotional codes, special offers, product incentives, or other benefits for themselves or their communities.
Unless expressly stated otherwise, Ambassador promotions:
- May not be combined with other offers;
- Have no cash value;
- May be modified or discontinued at any time; and
- Are subject to any additional terms communicated with the promotion.
Ambassadors may not alter, duplicate, create, or distribute unauthorized DE|RIVE® promotional codes.
5. FTC DISCLOSURE REQUIREMENTS
Your relationship with DE|RIVE® must be clearly and conspicuously disclosed whenever you promote or discuss DE|RIVE® products in connection with your participation in the Program.
You are responsible for complying with all applicable Federal Trade Commission (“FTC”) endorsement and advertising requirements.
Disclosures should be easy to notice and understand and placed with the applicable endorsement—not hidden in a profile, at the end of a long caption, or somewhere viewers are unlikely to see it.
Appropriate disclosures may include language such as:
“DE|RIVE® Ambassador,” “Paid partnership with DE|RIVE®,” “I earn commission from purchases made through my link,” “#ad,” or “#sponsored.”
Receiving free or discounted products, commissions, gifts, or other benefits from DE|RIVE® may constitute a material connection that must be disclosed.
Ambassadors are responsible for ensuring that their disclosures comply with current FTC guidance and applicable laws.
6. CONTENT & PRODUCT CLAIMS
We encourage Ambassadors to share genuine experiences and authentic content. However, all statements about DE|RIVE® products must be truthful, accurate, and consistent with DE|RIVE®-approved product information.
Ambassadors may not:
- Make false, misleading, or unsubstantiated claims;
- Claim or imply that DE|RIVE® products diagnose, treat, cure, or prevent any disease or medical condition;
- Make guarantees about individual results;
- Misrepresent clinical research, product ingredients, benefits, or performance;
- Make before-and-after claims that are misleading or not representative of an authentic experience;
- Present themselves as speaking officially on behalf of DE|RIVE® unless specifically authorized to do so; or
- Make statements about DE|RIVE® products that DE|RIVE® has expressly instructed Ambassadors not to make.
When discussing personal results, Ambassadors should make clear that they are sharing their own experience and that individual results may vary where appropriate.
DE|RIVE® may provide approved messaging, product education, brand guidelines, or other resources to help Ambassadors accurately represent the products.
7. CONTENT STANDARDS
Content associated with DE|RIVE® should reflect the integrity and professionalism of the brand.
Ambassadors may not use DE|RIVE® branding in connection with content that is unlawful, fraudulent, deceptive, defamatory, discriminatory, threatening, obscene, or otherwise reasonably determined by DE|RIVE® to be harmful to the brand.
DE|RIVE® reserves the right to request the removal or correction of content that violates these Terms, applicable law, or Program guidelines.
8. DE|RIVE® BRAND & INTELLECTUAL PROPERTY
DE|RIVE® may provide Ambassadors with approved logos, images, graphics, videos, product information, and other branded materials (“Brand Materials”) for use in connection with the Program.
DE|RIVE® grants approved Ambassadors a limited, revocable, non-exclusive, non-transferable license to use authorized Brand Materials solely for the purpose of promoting DE|RIVE® products while participating in the Program.
You may not:
- Alter DE|RIVE® logos or trademarks without permission;
- Create branding that could reasonably be mistaken for an official DE|RIVE® account, website, or communication;
- Register domain names, social media usernames, business names, or other identifiers incorporating DE|RIVE®, DE|RIVE MD, or confusingly similar variations without written permission; or
- Use DE|RIVE® intellectual property for purposes unrelated to the Program.
All rights to DE|RIVE® trademarks, branding, products, photography, graphics, and other intellectual property remain with their respective owners.
9. AMBASSADOR-CREATED CONTENT
You retain ownership of original content you create unless otherwise agreed in writing.
By tagging DE|RIVE®, submitting content directly to DE|RIVE®, or otherwise providing content to DE|RIVE® for promotional use, you grant DE|RIVE® a non-exclusive, royalty-free license to repost, share, display, and promote that content through DE|RIVE®-owned digital and social channels, with attribution where reasonably appropriate.
Any use beyond the scope described above may be subject to separate permission or agreement where required.
10. PAID ADVERTISING & SEARCH MARKETING
Unless expressly authorized in writing, Ambassadors may not purchase advertisements using DE|RIVE® trademarks, branded search terms, or variations of DE|RIVE® brand names.
Ambassadors may not create paid advertisements, websites, landing pages, or social accounts that could reasonably cause consumers to believe they are interacting directly with DE|RIVE®.
11. PROHIBITED ACTIVITIES
Ambassadors may not engage in activities designed to artificially generate commissions or manipulate Program tracking.
Prohibited activity includes, but is not limited to:
- Fraudulent orders or referrals;
- Creating fake accounts or identities;
- Misleading customers about promotions or pricing;
- Posting referral links or codes in a deceptive or unauthorized manner;
- Using bots, automated traffic, cookie stuffing, or similar techniques;
- Sending unsolicited commercial messages in violation of applicable anti-spam laws;
- Impersonating DE|RIVE® or its employees;
- Purchasing through your own referral link solely to generate commission unless expressly permitted; or
- Encouraging others to engage in fraudulent or abusive Program activity.
Violation of these requirements may result in withheld commissions and immediate removal from the Program.
12. INDEPENDENT RELATIONSHIP
Participation in the Program does not create an employment, partnership, agency, franchise, or joint venture relationship between you and DE|RIVE®.
Ambassadors participate as independent individuals and are responsible for their own equipment, expenses, business activities, taxes, insurance, and legal obligations.
You do not have authority to enter into agreements or make commitments on behalf of DE|RIVE®.
13. TAXES
Ambassadors are responsible for reporting and paying any federal, state, local, or other taxes associated with commissions or other compensation received through the Program.
DE|RIVE® may request tax documentation or issue applicable tax forms when required by law.
Failure to provide required tax or payment information may delay or prevent payment.
14. TERMINATION
You may leave the DE|RIVE® Ambassador Program at any time by contacting DE|RIVE® or following the applicable account procedures.
DE|RIVE® may suspend or terminate an Ambassador’s participation at any time, including for:
- Violation of these Terms;
- Fraudulent or abusive activity;
- Misrepresentation of DE|RIVE® products;
- Failure to comply with disclosure requirements;
- Conduct reasonably determined to harm DE|RIVE® or its reputation; or
- Extended inactivity.
Upon termination, your authorization to use DE|RIVE® Brand Materials, referral links, promotional codes, and other Program resources ends.
Any outstanding commission will be handled in accordance with the Program’s applicable payment policies and these Terms.
15. PROGRAM CHANGES OR TERMINATION
DE|RIVE® reserves the right to modify, suspend, or discontinue the Ambassador Program, including commission rates, incentives, promotional offers, eligibility requirements, and these Terms.
Material changes may be communicated through email, the Ambassador dashboard, the DE|RIVE® website, or another reasonable method.
Continued participation following the effective date of updated Terms constitutes acceptance of those Terms to the extent permitted by applicable law.
16. NO GUARANTEE OF EARNINGS
Participation in the DE|RIVE® Ambassador Program does not guarantee any particular level of income, commission, sales, audience growth, product benefits, or other results.
Ambassador earnings will vary based on numerous factors, including individual promotional activity and qualifying customer purchases.
17. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, DE|RIVE® and its affiliates, officers, employees, representatives, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from participation in the Program.
Nothing in these Terms limits any rights or remedies that cannot legally be limited or waived.
18. PRIVACY
Information collected in connection with the Ambassador Program will be handled in accordance with the applicable DE|RIVE® Privacy Policy and relevant privacy laws.
Program administration may require the collection and processing of information including your name, contact information, social media information, payment information, tax information, referral activity, and sales attribution data.
19. GOVERNING LAW
These Terms will be governed by and interpreted in accordance with the laws of [STATE], without regard to conflict-of-law principles.
Any disputes arising from these Terms or participation in the Program will be handled in accordance with applicable law and any additional dispute-resolution provisions adopted by DE|RIVE®.

ACCEPTANCE OF TERMS
By submitting an application to or participating in the DE|RIVE® Ambassador Program, you acknowledge that you have read, understood, and agree to these Ambassador Program Terms & Conditions.
